Terms of Use

USER AGREEMENT: newswatch.in provides its Service to you, subject to the following Terms of Service (“TOS”).This Agreement is for an indefinite term and by accessing the Website, you are agreeing to abide and be bound by the Terms of Service (TOS).

CHANGES IN TERMS OF SERVICE: newswatch.in reserves the right to add to or change/modify the terms of this Agreement including but not limited to suspend / cancel, or discontinue any or all channels, or service at any time without notice, make modifications and alterations in any or all of the content, products and services contained on the site without prior notice. Such changes will be posted on this page for your convenience to understand your responsibility as a user. You will be deemed to have accepted such change/s if you continue to access the Website subsequent to such changes.

DEFINITONS: In these Terms of Service, the following terms shall have the meanings set out below:
1. “newswatch.in” is the name of the Website hosted on the domain newswatch.in (and is identical to 3(b) below)
2. “Website” means the website hosted on the domain newswatch.in.
3. “Electronic Device” means a computer, mobile phone, WAP phone, personal digital assistant, or other electronic device capable of accessing the Websites;
4. “Content” means all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials posted on the Website;
5. “Service” means content, resources, tools for communication, public forums, commerce platforms furnished on the Website.

FEES: This Website reserves the right to charge subscription and / or membership fees in respect of any part, aspect of this Website upon reasonable prior notice.

PAYMENT: Where any goods or services offered via the Website requires payment:
1. It is your responsibility to ensure that your Electronic Device has the necessary technical specification to receive or use any content purchased from the Website.
2. All amounts payable must be paid in full in Indian Rupees (INR) (unless otherwise indicated) without any deductions or set offs
3. If any payment is not paid on time, your payment is rejected or refused (including if you do not have sufficient credit in your prepaid mobile phone account) or you default in payment, the amount owing will be treated as overdue and we will be entitled immediately to cease or suspend the provision of the relevant service to you until payment has been received, or your credit topped up.
4. You must be the bill payer of the particular method of payment that you use to pay for any service, or alternatively you must get the prior permission of the bill payer. You are also responsible for any charges charged by a mobile phone network operator or Internet Service Provider. These charges may not be in addition to the price of the service. Those additional charges are outside our control, and we will not be responsible for refunding them to you.

ACCEPTABLE USE POLICY: You agree to abide by all applicable laws, regulations and codes of conduct and ensure that any content uploaded or distributed or stored by you does not infringe the rights of others. All material on the Website and any material sent to you by e-mail or any other form from the Website (the “content”) or in any way relating to the Website belongs to those indicated in Clause 9 below or us. You may retrieve and display content from the Website on the Electronic Device on which you first accessed it or downloaded it, print a single copy of individual pages on paper and store such pages for caching purposes only, all for your personal and non-commercial use alone. We, or those copyright owners mentioned in Clause 9 below, own the copyright and all other intellectual property rights associated with the content, save where otherwise stated. You may not do any of the following without prior written permission from us:
1. reproduce the content (other than allowed under this Acceptable Use Policy), or modify or in any way commercially exploit any of the content;
2. redistribute any of the content (including using it as part of any library, archive or similar service);

4. create a database in electronic or structured manual form by systematically downloading and storing all and any of the content.
In accessing the Website, you agree not to:
1. impersonate another person or use a false name or a name you are unauthorised to use or create a false identity or e-mail address or try to mislead others as to the identity or origin of any communications;
2. modify, access or make available data stored on a computer device which you have accessed through the Website;
3. make available or upload files that contain software or other material, data or information not owned or licensed to you or collect information about others (eg names/addresses) without their prior consent;
4. damage, interfere with or disrupt access to the Website or do anything which may interrupt or impair their functionality;
5. make any commercial or business use of the Website or resell or commercially benefit from any part or aspect of the Website;
6. publish, post, distribute, disseminate or otherwise transmit defamatory, offensive, infringing, obscene, indecent or other unlawful or objectionable material or information;
7. threaten, harass, stalk, abuse, disrupt or otherwise violate the rights (including rights of privacy and publicity) of others;
8. make available, upload or distribute by any means any material or files that contain any viruses, bugs, corrupt data, “trojan horses”, “worms” or any other harmful software;
9. falsify the true ownership of software or other material or information contained in files made available via the Websites;
10. obtain or attempt to obtain unauthorised access, through whatever means, to the Website, other services or computer systems or areas of our or any of our partners’ networks.
newswatch.in retains the absolute right to prevent you from accessing the Website, without prejudice to any of our accrued rights, where we in our reasonable discretion consider that you are contravening our Acceptable Use Policy or any other term or condition of these Terms of Service, and we have informed you of your contravention or breach.

JURISDICTION: It is your responsibility to ensure that your use of the Website is not contrary to the laws of your country of residence. This Agreement shall be construed in accordance with the laws of India and the courts in New Delhi, India only shall have the exclusive jurisdiction to entertain and try any claims, differences and dispute arising out of or in relation to this Agreement. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.

PRIVACY POLICY: newswatch.in is committed to protecting your privacy and will collect no personal information about you unless you choose to provide that information to us. newswatch.in has drafted this document, which details how we gather and disseminate information, in an effort to demonstrate our strong commitment to online privacy. Please contact us if you have any questions about our privacy policy.
1. Use of Internet Protocol Address: We use your Internet protocol (IP) address for several reasons to help diagnose problems with our server or to administer our website
2. Use of Registration Information: We do not have a registration process yet. But in case we do, our site’s registration area would require visitors to supply their e-mail address for the opt-in mailing list. We use this information to send you newsletters from newswatch.in. Users may choose to opt out, at any time.
3. Use of Cookies: We do not use cookies. However, in the course of serving advertisements to this site, our third-party advertiser may place or recognise a unique “cookie” on your browser.
4. Use of Demographic Information: We do not collect demographic and profile data as yet.
5. Children’s Guidelines: We do not collect or use any online contact information or identifiable off-line contact information about a child without parental consent. We do not distribute personally identifiable information about children without parental consent. We do not give children the ability to post or distribute personal information without prior consent. We do not entice children with games or contests that would encourage them to disclose personal information.
6. Opt Out/Opt In: newswatch.in allows users to opt out of receiving e-mail from us. To opt out of our mailing list you can send e-mail to a remove mailing list.

FAIR USE NOTICE: The news items and articles/features collated in newswatch.in are copyrighted material whose use has not been specifically authorised by the copyright owner. newswatch.in is archiving these in a bid to make hard information on the journalism, press freedom and the news media industry readily available to researchers, scholars, journalists, students, and others looking for background information. The site serves as a not-for-profit, non-partisan online resource library and the goal is dissemination of knowledge/information to the public. newswatch.in believes this constitutes a ‘fair use’ of the copyrighted material. However, the download time may vary considerably between the types of content and you agree that you are wholly liable and responsible for any telephone call and/or other charges incurred in downloading the same. However, we will use reasonable endeavours to notify you of the size/amount of the file/data and the likely download time for your information.

E-COMMERCE: Your dealings with any third parties, in particular advertisers and/or merchants, via the Website, and any terms or conditions agreed with, or representations given by, such third parties, are solely between you and such third party. You agree that we are not liable for such dealings, and that you will be liable for any costs or damages that we incur, as set out in clause 13 above in relation to such dealings.

GENERAL: You may not assign, sub-license or otherwise transfer any of your rights under these Terms of Service without our agreement, which will not be refused without good reason. If any part of these Terms of Service is found to be invalid by any court having competent jurisdiction the validity of the remaining terms will be unaffected. If either party does not exercise any right or remedy under these Terms of Service, this will not be taken to mean that they have been waived.

FORCE MAJEURE: newswatch.in shall have no liability to you for any interruption or delay in access to the Website irrespective of the cause.

ENTIRE AGREEMENT: These Terms of Service constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter.
